Disability and the right to reasonable adjustments in the workplace

Arthritis and work

Living with arthritis can be challenging – not just in your personal life, but at work as well. Pain, stiffness and fatigue can affect daily work, but with the right adjustments, it is perfectly possible to continue working and thrive in your career.

It is important to remember that laws and regulations guarantee you right to reasonable accommodation in the labour market. This is not mercy but a right based on law.

What does 'reasonable adjustment' mean?

Reasonable adjustment is the adjustment of working conditions, tasks or working hours so that a person with arthritis can do their job on an equal basis with others.

Example of adaptation:

  • Flexible working hours or part-time work to accommodate fatigue or medical appointments
  • Accessible working conditions (e.g. lifts, supportive chairs, a desk at the correct height, a height-adjustable desk, good lighting)
  • Aids such as a keyboard, mouse or specialised tools
  • Homework part of the week
  • Amended project if the workload proves to be too onerous

What are your rights?

  • According to Act on equal treatment in the labour market (no. 86/2018) prohibits discrimination against individuals on the grounds of disability or chronic illness.
  • An employer has duty to make appropriate and reasonable adjustments, so long as they do not involve an undue burden on the employer.
  • You have the right to discuss your needs openly with your employer and request solutions that enable you to keep your job.
  • If an employer refuses without good reason, it may be considered discrimination.

Where do you get support?

  • Employment ServiceOffers advice on rights and resources in the labour market.
  • Your trade unioncan provide advice, legal assistance and even grants in connection with integration.
  • ÖBÍ Rights AssociationProvide education and advice, and can support you in your dealings with your employer.
  • Social workers and healthcare professionalscan prepare a certificate explaining the need for an adjustment.

Good to remember

  • You don't have to hide your illness – discussing your needs can ensure that your work is better and healthier in the long term.
  • Reasonable adjustments are a legal right – not a privilege.
  • Solutions are available, but it requires cooperation between you and your employer.
  • With the right support, people with arthritis can take full part in the workforce, just like anyone else.

💙 The aim is not just for you to keep a job, but for the job to suit your health and quality of life.
